The US and Luxembourg legal regulations, which both govern the private sector involvement in State space activities and allow citizens to freely engage in the development of planets and asteroids, to own and dispose of resources, including water and minerals, are under analysis. Therefore, due to the occurrence of legal collisions, the International Law Association and the Space Law Committee, established on its basis, should influence regulating space issues. These institutions are known for their open policies and extensive external relations. Their key mission is to study, clarify and develop international public and private law and prepare comparative law research. The author concludes that being an important human resource, space objects and natural resources should belong to all humanity, not to individual States or private enterprises. The adoption of the US and Luxembourg legislation on legalizing, extracting, using and appropriating space resources by private enterprises seems to be in full compliance with international obligations, however, in fact they violate the principles governing the activities of States in the exploration and use of outer space, including the moon and other celestial bodies, which are not subject to national appropriation, neither by proclaiming sovereignty, nor by uses or occupation, nor by any other means.Тип елементу:Документ, Trends in Digital Governance in the Field of Space Activities(Приватна установа "Науково-дослідний інститут публічного права", 2021) Danylenko, Anna; Levchenko, DianaThe relevance of this article is based on the need to find an answer to the question: are there mechanisms in the legal field and at the level of the management concept for adaptation to the inevitable evolutionary processes of the space industry, or is it necessary to look for new ways to regulate space activities? To answer this question, the authors needed to study the scientific doctrine, international acts and individual national norms of Ukraine regarding the identification of prerequisites for the development of global and national digital governance in the field of space activities, as well as the prospects for its proper functioning. The research is based on the use of a set of methods and techniques for carrying out scientific research. The main ones among which were the methods of analysis and synthesis, the formal-legal and the method of formalization. As a result of the study, it was stated that legal regulation does not keep pace with the development of the space industry and does not have the ability to cover all modern aspects of space activity with its influence. This leads to the need for a transition from formal bureaucracy to digital democracy in the aspects of legal regulation of space legal relations at the global and national levels. The implementation of scientific research is ensured by the combined use of methodological tools, among which the leading role was played by general scientific methods of analysis and synthesis, deduction and induction, which provided an opportunity to identify general and specific features of the research. The main methods were forecasting and legal modeling, which helped to identify trends in the development of organizational and legal support for the use of space information and technology in the military activities of Ukraine. The study revealed that Ukraine has significant prospects for developing an organizational and legal framework for using space information and technology in military activities. It is crucial to support and adapt the experience of the troops (forces) of the Armed Forces of NATO member states, which for decades have demonstrated a systematic, balanced and clear approach to the tasks of the supranational level of security. Providing such an opportunity is combining general theoretical and special legal methodology of conducting scientific research. Research results. The authors studied the issues of its organizational and implementation components to form a common vision regarding the evolution of the public administration paradigm in general, as well as its features at the current stage of Ukraine’s development as an independent democratic state that is in armed confrontation with an aggressor country. Practical implementation. Since the declaration of Ukraine’s independence, an attempt has been made to optimize the institutional aspect of socio-economic and political reforms, but we may assert that the path chosen at that time was wrong, because it would be more appropriate to conduct administrative reform in a different direction. In this regard, there is still a tendency to constantly optimize domestic legislation and adapt it to the basic principles of public administration which have proven their effectiveness abroad. Value/originality.
